Welcome to Herbistry420. These Terms & Conditions (“Terms”) govern your use of the website herbistry420.com (the “Site”) and any purchases you make through our online store. By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our Site or make any purchases.

1. Eligibility

Our Site contains content related to cannabis education and reviews. By using this Site, you confirm that you are at least 21 years of age or the legal age required in your jurisdiction to view cannabis-related content and make purchases. If you are under 21, you may not use this Site or place orders.

2. Products & Services

Herbistry420 sells merchandise, original artwork, and print-on-demand products through our online store powered by WooCommerce. Product descriptions, images, and specifications are provided for informational purposes and may vary slightly from the actual product due to differences in screen displays and the handmade or print-on-demand nature of certain items.

We reserve the right to limit quantities, discontinue products, or modify product offerings at any time without prior notice.

3. Pricing & Payment

All prices are listed in US dollars (USD) unless otherwise indicated. Prices are subject to change without notice. We are not responsible for typographical errors in pricing. If a product is listed at an incorrect price, we reserve the right to cancel the order and issue a full refund.

Payment is processed securely through third-party payment providers (Stripe and PayPal). We do not store your credit card or payment details on our servers. By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method.

All applicable taxes and shipping charges will be calculated and displayed at checkout before you complete your purchase.

4. Shipping & Delivery

We ship to addresses within the United States and select international destinations. Shipping costs and estimated delivery times are calculated at checkout and vary based on your location and the shipping method selected.

Please note:

  • Print-on-demand items are produced after your order is placed and may require additional processing time (typically 3-7 business days) before shipping
  • Original artwork is carefully packaged and may require additional handling time
  • Delivery times are estimates and are not guaranteed. Herbistry420 is not responsible for delays caused by carriers, customs, or events beyond our control
  • Risk of loss and title for items pass to you upon delivery to the carrier

5. Returns & Refund Policy

We want you to be happy with your purchase. However, due to the nature of our products, our return policy varies by product type. Please read the following carefully before making a purchase.

Print-on-Demand Products (Non-Returnable)

Print-on-demand items (including custom t-shirts, hoodies, mugs, and other printed merchandise) are made to order specifically for you and cannot be returned or refunded simply because you changed your mind. This applies to all customers, including those in the European Union. Under Article 16(c) of the EU Consumer Rights Directive (2011/83/EU), the 14-day right of withdrawal does not apply to goods that are made to the consumer’s specifications or are clearly personalized.

We will, however, gladly provide a replacement or full refund for print-on-demand items that:

  • Arrive damaged or defective (e.g., printing errors, tears, manufacturing defects)
  • Are the wrong item (you received a different product than what you ordered)
  • Are the wrong size due to a fulfillment error (not due to incorrect sizing by the customer)

Original Artwork

Original artwork may be returned within 14 days of delivery, provided the item is in the exact same condition as it was sent — undamaged, with all original packaging materials. A 35% restocking fee will be deducted from your refund to cover costs associated with shipping, handling, and inspection of the artwork.

Artwork that is returned damaged, altered, or not in its original condition will not be accepted and will be shipped back to you at your expense.

Damaged or Incorrect Items

If you receive a damaged, defective, or incorrect item of any type, please contact us within 7 days of delivery with:

  • Your order number
  • Photos of the damaged or incorrect item
  • A description of the issue

We will review your claim and, at our discretion, provide a replacement, exchange, or full refund including original shipping costs.

Non-Returnable Items

The following items cannot be returned or refunded (unless damaged or incorrect):

  • Print-on-demand / made-to-order products
  • Sale or clearance items (all sales final)
  • Digital products or downloadable content
  • Gift cards

Return Process

To initiate a return, please contact us through our contact page to request a Return Merchandise Authorization (RMA) number. Do not send items back without an RMA number — unauthorized returns will not be processed.

Once approved:

  1. Package the item securely in its original packaging
  2. Include the RMA number with your return
  3. Ship to the address provided in your RMA confirmation
  4. Use a trackable shipping method — we are not responsible for returns lost in transit

The customer is responsible for all return shipping costs unless the return is due to our error (wrong item shipped, defective product).

Refund Processing

Once we receive and inspect your return, we will notify you by email of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 14 business days. Please note that your bank or payment provider may take additional time to post the refund to your account.

EU Consumer Rights

If you are a consumer in the European Economic Area (EEA) or United Kingdom, you have the right to withdraw from a purchase of standard (non-customized) goods within 14 days of delivery without giving a reason, in accordance with the EU Consumer Rights Directive (2011/83/EU). This right does not apply to:

  • Goods made to your specifications or clearly personalized (e.g., print-on-demand items) — Article 16(c)
  • Sealed goods that have been unsealed after delivery and are not suitable for return due to health or hygiene reasons — Article 16(e)
  • Digital content delivered electronically once performance has begun with your consent — Article 16(m)

For eligible standard goods, to exercise your right of withdrawal, contact us through our contact page within 14 days of receiving your order. You will be responsible for the cost of returning the goods.

6. Order Cancellation

You may request to cancel an order by contacting us as soon as possible after placing it. However, please understand:

  • Print-on-demand orders enter production quickly and may not be cancellable once production has begun
  • Shipped orders cannot be cancelled — please refer to our return policy above

If cancellation is possible, you will receive a full refund to your original payment method.

7. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, images, artwork, videos, audio, and software — is the property of Herbistry420 or its content creators and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this Site without our express written permission. Purchasing a product does not grant you any intellectual property rights to the designs, artwork, or branding associated with that product.

8. User Accounts

When you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Update your information promptly if it changes
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

9. Prohibited Conduct

When using our Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws

11. Limitation of Liability

To the fullest extent permitted by applicable law, Herbistry420, its owner, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:

  • Your use of or inability to use the Site
  • Any products purchased through the Site
  • Any content or information obtained from the Site
  • Unauthorized access to or alteration of your data

In no event shall our total liability exceed the amount you paid for the specific product or service giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.
